Your LGBTQ parenting journey: Questions to ask

Before you start your parenting journey, here are some important questions to consider.

  • Is having children who are biologically related to you important? Not important? Or somewhere in between?
  • What's your budget?
  • How many children do you want to have?
  • What's the ideal timing for you? This depends on many factors, from physical (a woman's fertility diminishes with age, for example) to personal (you want to have children around the same time as close friends or family, for example).
  • If you're married or in a committed relationship, do you and your partner agree about whether, when, and how to have kids?
  • If you're single, do you have a good support system?
  • Are you prepared to weather the process of becoming a parent? It may take more time or money than expected and hit frustrating bumps.

Deciding how to build your family

The good news: You have lots of options. The bad news? You have to make some decisions. But once you're sure you want to proceed, you can begin the exploration and work of deciding which path to parenthood is best for you. To understand the basics of your choices in various scenarios – and why you might choose one over another – read on.

Option: Insemination

Why you would choose it: You (or your partner) would like to carry a child.

You can pursue insemination by an unknown donor – or by a known donor such as a friend or relative. Sperm banks have become more welcoming in recent years to lesbian, bisexual, and queer women who want to parent singly or as a couple.

Before trying to get pregnant, it's a good idea to have a medical workup to determine your ability to conceive. And if you're in a lesbian relationship, you'll need to decide which one of you wants to carry a baby, or if you both want to try.

Unknown donors

If you'd like to use an anonymous donor, you'll go through a sperm bank. You don't have to find a bank near you, either. Alice Ruby, executive director of The Sperm Bank of California (TSBC), recommends choosing a bank based on its policies rather than its location, because most banks will ship sperm across the country.

To help you choose an anonymous donor, sperm banks supply information such as the donor's height, weight, hair and eye color, ethnic background, health history, and profession. All donors undergo detailed medical screening for things like HIV and other sexually transmitted diseases.

Every sperm bank is different. So before choosing one, find out whether the one you're considering is LGBTQ friendly and read its policy statements carefully. There are even banks that specialize in serving lesbian couples and single women.

Also ask whether the bank has an identity-release program and how it works. Typically, a bank that uses identity release (also called "open donor") will release donor contact information to your child at age 18.

Known donors
Some lesbian couples and single women choose a friend or relative as a donor.

If you'd like to use a known donor, you can skip the sperm bank and use a more home-grown approach. This can save you a lot of money.

You also have the option of using a sperm bank to medically screen and store your known donor's sperm. Sperm banks typically refer to known donors as "directed donors."

Either way, it's important to recognize that using a known donor often comes with complicated legal and personal implications. (For more details, see "Legal issues," below.)

You have to decide and agree on the future relationship (if any) between your child and the donor. Do you want this person to play the role of a parent or other close relative, have a more distant relationship, or have no relationship at all with your child?

Method of insemination
Your insemination options and how and where insemination takes place depend on who your donor is and a few other factors.

If you're using a sperm bank for an unknown or known donor

Sperm can usually be picked up or shipped to you. Sperm is perishable so it has to be shipped properly to make sure it's still viable when it gets to you. And then you can choose to be inseminated at home or in a medical setting.

VI (vaginal insemination): Sperm is deposited in the vagina near the cervix, using a variety of simple methods. It can be done at home or in a medical setting. You can choose to use "washed" or "unwashed" sperm. Washed sperm is more expensive but may give you a better chance at pregnancy.

IUI (intrauterine insemination): Sperm is delivered through the cervix and deposited inside the uterus by a medical professional. You have to use "washed" sperm for this procedure.

If you're not using a sperm bank

There are various ways of collecting and using sperm from a known donor. Typically it happens at home. For help figuring out the logistics of getting pregnant with donated sperm, search online using terms such as "at home insemination" and "insemination with syringe or cup."

VI (vaginal insemination): Fresh sperm is deposited in the vagina near the cervix. It may be injected with a syringe or held near the cervix with some sort of cup. This is the only method available if you're not using a sperm bank, because the washed sperm you need for IUI is not an option. You can do it on your own or have a trained professional such as a midwife help you.

Cost: Expense varies based on many factors, including the health and age of the prospective parent and whether fertility treatments are involved. As of December 2016, at The Sperm Bank of California, a 1-cc vial of frozen sperm for use at home cost $640. The price goes up to $720 per vial for "washed" sperm (required if you're doing IUI). And if you're doing IUI, you'd have to pay the additional cost of having someone perform the procedure.

Legal issues
There are usually no legal hurdles when you use an unknown donor through a sperm bank.

If you work with a known donor – with or without a sperm bank – proceed with caution.

Where you live can affect your decisions because state laws vary. Most experts agree it's essential to sign a sperm-donor agreement before conception to protect yourself and your donor. You may want to consider having insemination done by a doctor, depending on the laws in your state.

In many (but not all) states, if the procedure is done by a doctor, the donor is not considered the legal father. But if it's done at home, the donor's status is much less clear. In other words: Get the legal scoop for your state before you try to get pregnant.

If you've asked a friend to be a donor, it may feel very clinical to ask that person to sit down with a lawyer and hash out the details. But it can save you a lot of grief down the line.

A typical agreement spells out details such as:

  • How much contact (if any) the donor can have with your child
  • That the donor does (or does not) give up all rights to parenthood
  • That the recipient(s) do (or do not) relinquish any claim to child support.

You can find sample agreements on the websites of attorneys who specialize in reproductive law and on LGBTQ parenting websites.

Whether you use a known or an unknown donor, if you're in a committed relationship, the National Center for Lesbian Rights (NCLR) recommends that the nonbiological parent legally adopt your baby – even if you're married and she's on the birth certificate.

This legal procedure, known as a second-parent adoption, allows a same-sex parent to adopt, whether or not the couple is legally married.

Option: Using a surrogate

Why you would choose it: You can't or don't want to carry a baby, but you want your child to be genetically related to you

A surrogate is someone who agrees to carry a child for someone else. Her pregnancy could result from artificial insemination (which uses her egg, making her biologically related to the child) or from a fertilized egg transferred to her uterus (gestational surrogacy).

How surrogacy works
The future parent or parents and the surrogate sign a legal agreement that details such issues as parental rights, custody, payment of medical bills, control over medical decisions, where the baby will be born, and the surrogate's medical history. It also spells out financial arrangements, such as how the surrogate will be compensated, payment of legal fees, and even who pays for maternity clothes.

Depending on your situation, needs, and family plans, the eggs or sperm can be from a partner, a relative or friend, or a donor. Some male gay couples have half the eggs fertilized with sperm from one of them and half with sperm from the other – giving each a chance at becoming a biological father.

With surrogacy, you can be part of your child's life from the beginning, attending doctor visits, hearing the baby's heartbeat, and witnessing each stage of pregnancy.

Cost
Be prepared to spend $100,000, according to Eric Rosswood, author of Journey to Same-Sex Parenthood. This covers agency and lawyer fees, part of the surrogate's expenses, and medical expenses. In addition, the cost of fertilization or delivery may not be covered by insurance.

Legal issues
Laws vary from state to state. For example, in New York, it's illegal to hire a surrogate. In California, the process is legal, and there are agencies that specialize in connecting parents with potential surrogates.

Option: Adoption

Why you would choose it: You don't have strong feelings about carrying a baby or being genetically related to your child.

Adoption is a common route to parenthood for LGBTQ parents. It can be a lengthy process, and there are many ways to go about it, including domestic private- or public-agency adoption, adoption from foster, independent domestic adoption, and international adoption. You have to decide:

  • Whether you want to adopt an infant or an older child
  • Whether you're open to adopting a child of a different race or with special needs
  • How long you're willing to wait
  • Whether you want to pursue a domestic or international adoption (If you choose a domestic adoption, you may be able to have a relationship with the birth mother or birth family.)
  • What your budget is. Costs vary greatly, depending which route you take.

Laws related to adoption by single-sex couples and LGBTQ parents vary from state to state and country to country, so it's a good idea to consult a lawyer before deciding which route to take.

If you decide to work with an attorney for private adoption, speak to a few to find the right fit, suggests Suzanne Nichols, a New York attorney who specializes in adoption. Look for lawyers who have experience with LGBTQ parents, and vet your choices with the American Academy of Adoption Attorneys.

Agency
There are private adoption agencies and public ones, such as county social services. Public agencies usually place children who are wards of the state, such as orphans or children who have been abandoned or abused. Private agencies generally place children whose birth family is not able to support a child.

Foster-to-adopt
Parenting can begin – and offer an ongoing, deeply rewarding experience – with fostering a child whose current parents can no longer care for him or her or whose parental rights have been terminated, due to neglect or incarceration, for example.

If you're looking for a lower-cost way to legally adopt, foster-to-adoption might be the right choice. The vast majority of children adopted from foster care receive a subsidy. This removes some of the financial barriers families face and helps them meet any special needs the child may have.

Adopting a foster child can be a long process. Prospective parents should plan on spending nine to 18 months for a home study, orientation, and preparation classes. Licensing requirements vary from state to state.

Additionally, there may be legal issues for LGBTQ parents who want to foster-to-adopt. Right now, only seven states have laws upholding the rights of LGBTQ people to foster, and Nebraska prohibits it. A bill called the Every Child Deserves a Family Act, which would prohibit federally funded child-welfare agencies from discriminating against adoptive families on the basis of sexual orientation, was introduced in the Senate in 2015, but it has yet to get to a vote.

Independent domestic adoption
In an independent adoption, no agency is involved. Prospective adoptive parents either deal directly with the birth parents or choose a go-between, such as a lawyer who specializes in adoption. Attorneys then guide prospective parents in dealing with paperwork and submitting filings to court.

Independent domestic adoptions can be either open or closed. If the adoption is closed, the child and his or her new family will have no contact with the birth parents and the records are sealed. If the adoption is open, the adoptive parents and birth parents may have contact before the baby is born and the new parents may maintain some level of contact.

International adoption
International adoption was a viable option for LGBTQ parents a decade ago, but it has become increasingly difficult.

If you're part of a couple and decide to pursue international adoption, you can choose to have only one of you present as the adopting parent. Then the second parent may adopt once the child is on U.S. soil. You're legally required to answer honestly, though, if the foreign government asks if you're lesbian or gay.

Legal and other issues
Each state has its own laws on adoption, and they can be bewildering. Spending some of your budget on a trusted local agency or attorney to guide you through the process will save a lot of headaches.
